Facts

On February 28, 2020, Tamir Qadree sued her former employer, ADT LLC, for wage-and-hour violations, seeking to represent persons who worked for ADT as commission-paid outside salespeople from February 28, 2016 through October 13, 2023 and did not sign or opt out of the arbitration agreement. On November 24, 2020, a Private Attorneys General Act cause of action for appropriate penalties was included.

Contentions

PLAINTIFF'S CONTENTIONS: Plaintiff contended that defendant failed to: compensate for rest periods and other non-productive time; pay minimum wages; provide and record meal periods; authorize and permit rest periods; provide and maintain compliant wage statements; maintain payroll records; timely pay wages during employment; pay wages on termination; pay costs of medical or physical examination; reimburse necessary business expenses; and provide written notice of material terms of employment. Finally, plaintiff also accused defendant of violating labor laws pertaining to secret payment of lower wages.

DEFENDANT'S CONTENTIONS: Defendant strongly denied violating any laws or failing to pay any wages, asserting it complied with all applicable laws.

Settlement Discussions

On December 14, 2022, the parties participated in an all-day mediation presided over by Daniel Turner which led to a settlement agreement.

Result

Defendant agreed to settle for a maximum amount of $485,000.
