Facts

On April 26, 2021, Maryland native Helen Mattson was visiting San Francisco. As she was walking on the north sidewalk of McAllister, between Lyon and Baker streets, she tripped on a defective portion of the sidewalk. On December 2, 2021, Mattson sued the City and County of San Francisco for premises liability.

Contentions

PLAINTIFF'S CONTENTIONS: Plaintiff asserted that when she was injured, she was wearing appropriate footwear and was reasonably attentive as she walked. Moreover, the sidewalk's dangerous condition demonstrated actual or constructive notice.

DEFENDANT'S CONTENTIONS: Defendant denied material contentions.

Injuries

Plaintiff fractured her left kneecap and alleged experiencing dementia and depression due to the fall. Most of plaintiff's treatment occurred in Maryland.

Result

The case settled for $190,000.
