Facts

Plaintiff Ann Dobbs, a 60-year-old psychotherapist (and widow), is the owner of a single family residence in Monterey Park. In 1989 she hired a contractor to remodel her home and to add a second story. She terminated the first contractor and then hired Defendant Steven Louie, an unlicensed contractor, to complete the work. She then terminated the Defendant in 1991 and hired other contractors to complete the remodeling.

Settlement Discussions

Defendant contends they offered $100,000 at the MSC; $200,000 at trial; and Plaintiff demanded $350,000 before trial with an indication of $250,000 (possible).

Specials in Evidence

$22,000 $80,000

Damages

Plaintiff claimed that she spent over $160,000 to finish the project and that the project still needs an additional $60,000 work to be completed. Plaintiff further claimed additional financing costs of $61,000; loss of income of $80,000; medical specials of $22,000; and emotional distress damages in the amount of $300,000. Plaintiff also sought punitive damages.

Other Information

This case was bifurcated. In August, 1993, a bench trial was held before Judge Krieger; Defendant (represented by different counsel) was found liable to Plaintiff for breach of contract and fraud in the inducement and billing; and the case proceeded on the issue of damages, before a jury in January of 1994.
