Facts
On November 5, 1990, Plaintiff, a 46-year-old recreational vehicle salesperson, was driving a 1981 Suncrest motor home to Chavez Ravine (Dodger Stadium) for a recreational vehicle show for her employer. As she proceeded westbound on I-10, she encountered heavy traffic. She brought her vehicle to a complete stop in the number 3 lane. Defendant was also proceeding westbound on I-10, travelling at approximately 55 mph in the number 1 lane, in her 1979 Toyota Celica. As Defendant approached the scene, she realized the traffic was stopped. When she attempted to bring her vehicle to a stop, she lost control, struck the center divider, and careened into the Plaintiff's vehicle. As a result of the collision, the Toyota was a total loss and the motor home sustained approximately $12,000 property damage.
Settlement Discussions
Plaintiff contends she demanded the policy limits of $25,000 in September of 1991, withdrawn and increased to $225,000; and Defendant offered her policy limits of $25,000.
