On August 6, 1990, at approximately 11:15 a.m., Plaintiff Michelle Salmas, a 36-year-old real estate agent driving her 420 SEL Mercedes Benz, was struck in a rear end collision by a bob-tail truck owned by Defendant Thompson Building Materials and driven by Defendant John Fig. At the scene of the accident, the Plaintiff allegedly told the investigating highway patrol officer that she caused her vehicle to shift from "drive" to either "park" or "reverse" when she reached for her purse, because the strap was wrapped around the gear shift lever.
