On May 8, 1989, Plaintiff Richard Velez, a 30-year-old unemployed carpenter, was shopping in a North Hollywood retail store operated by Defendant Kmart. Plaintiff alleged that he was pushing a shopping cart when he slipped on some clear liquid and fell to the floor, striking his right knee.
