On December 16, 1991, Plaintiff, a 35-year-old printer, was jailed at Defendant County jail for failure to pay a shoplifting fine. During the booking process, he refused an X ray, and the Defendant's deputies locked him in an unsupervised hallway with a court-certified "danger-to-others," mentally deranged inmate. Plaintiff at the time stood approximately 5 feet, 5 inches and weighed only 125 pounds; the mentally disturbed inmate stood approximately 6 feet, 3 inches and weighed 235 pounds. The mentally disturbed inmate attacked Plaintiff causing severe and irreversible brain damage.

Settlement Discussions

Plaintiff contends they demanded $3,500,000 and Defendant offered $900,000 cash, plus an annuity providing $120,000 per year for life and $150,000 a 15-year trust.
