Facts
On December 25, 1991, Plaintiff Fruma Itzkovitz, a 42-year-old Midas Muffler Shop manager, was having breakfast at a coffee shop restaurant in the Las Vegas Hilton Hotel, when the chair on which she was sitting, broke causing her to fall backwards. The chair had been manufactured by Defendant Shelby Williams, Inc., and had been returned to the factory to correct a defect, prior to this incident. Defendant admitted that it negligently failed to correct the problem.
