Facts

On February 25, 1991, a team of police officers from Defendant City of San Bernardino went to an apartment complex. They were requested to pursue an armed robbery suspect; the request was made by the Rialto Police Department and the apartment manager. A person matching the physical description of the suspect was asked by Defendant Officer Keith to stop. That person ran into Plaintiff Daniel Wesley's apartment. When the officer pursued the suspect, Plaintiff tried to block the officer's entry. Defendant Officer Keith, with his gun in hand, pushed Plaintiff. Plaintiff was a 22-year-old security guard at the time.
