Plaintiff Bahman Moghadam, a 48-year-old business man, rented a welding kit from Defendant Sam's U-Drive in December of 1990. He returned the first kit as defective, obtained a replacement which he used for several days, and returned the second welding kit for a third kit. Plaintiff later returned that kit as defective and claimed that he had sustained a burn injury due to the product's dangerously defective condition.
