On August 2, 1991, a 38-year-old janitor and employee of Defendants, was injured while acting in the course and scope of his employment (disputed), when instructed to take a banner up a ladder on the roof of a building. Under the Labor Code, Plaintiff was an employee; and Defendants failed to secure payment of compensation as required by the Labor Code.
