In November of 1992, Cross-complainant Gregory Blanc retained Cross-defendants Coldwell Banker and Sharon Davis to sell his El Cajon home. Blanc kept two Rottweilers on the property in the backyard in a fenced area separated from where people had access. On February 28, 1993, a potential buyer family (Plaintiffs in the underlying case) were being shown the home by Bill Roberts, another Coldwell Banker agent, from the same office as sales agent Davis. The family included two young children, ages 3 years and 5 years. A sign made by Cross-defendants had been placed on the door leading to the backyard, allegedly advising people to stay within the fenced area separating the people from the dogs. The family went through a gate leading into the area where the dogs had access and were attacked by the two Rottweilers.

Settlement Discussions

Cross-complainant contended that they demanded $220,000 and Cross-defendants offered $56,000.

Damages

$440,000 paid in settlement of the underlying case.
