Facts

On October 9, 1982, Defendant's home was consumed by fire. He then made a claim to his insurers for more than $2,000,000. Plaintiff's firm was assigned to investigate the claims. As a result of that investigation, Plaintiff established that the cause was arson and that Defendant had attempted to perpetrate fraud and caused the policies to be declared void. Following unsuccessful appeals, Defendant in propria persona filed a lawsuit against Plaintiff, seeking damages. The Court dismissed the complaint; and Plaintiff filed the instant suit to recover the damages to defend.

Settlement Discussions

Plaintiff contends they demanded $25,000 and Defendant offered $25,000 to settle the instant case.

Damages

Legal costs and attorney fees to defend the underlying case, valued at more than $25,000. Plaintiff also sought punitive damages for malicious prosecution.
