Facts
On July 20, 1991, Plaintiff Paul Hronec, a 74-year-old operator of a home for dependent adults and retired military, underwent an angioplasty at Defendant Mercy General Hospital. On July 21, 1991, the angioplasty sheaths were removed, and Plaintiff Hronec was placed in the cardiac telemetry unit. Hronec ambulated twice and experienced dizziness secondary to hypotension. He was told to stay in bed unless assisted and 2 of 4 side rails were placed in the up position. Hronec then claimed he needed to use the bathroom and no bedside urinal was present; Plaintiff got out of bed and took 6 or 7 steps before he fell. The nature of the accident was disputed.
