Facts

On April 4, 1992, Plaintiff, a 27-year-old software technical support clerk, was riding her bicycle in an eastbound direction on MacArthur Boulevard. Plaintiff looked behind her to see Defendant's bus approaching her lane of travel. As the bus approached, Plaintiff began to pass a parked car to her right. The bus driver allegedly did not see Plaintiff. The bus overtook Plaintiff just as she had nearly finished passing the parked car. The bus then struck Plaintiff's bicycle and the impact of the collision propelled Plaintiff forward. Plaintiff landed in front of the parked car.
