Facts
On June 4, 1988, Fathi Mohareb, a 49-year-old toxics inspector, was killed while performing his work duties at the Spadra Landfill in Walnut. As a hazardous-waste inspector, Mohareb conducted inspections of commercial and non-commercial trash trucks for hazardous waste. On the day of his disappearance, he was last seen approaching (on foot) a stopped commercial vehicle at the dumping line when Defendant's refuse truck was backing in the same area. About 45 minutes later, Mohareb's disappearance was noticed by co-workers of the Los Angeles County Sanitation District. A search was then begun by going through hundreds of tons of trash. The body was finally located 2 days later, buried under trash. Plaintiffs were the decedent's wife and three minor children.
