Facts
This case arose out of a personal injury accident which occurred in Glendale on October 29, 1991. Plaintiff, a 38-year-old construction worker, employed by Plaintiff-in-Intervention, a construction company. At the time, work crews from the Defendant company and Plaintiff-in-Intervention were working on their own projects at the intersections on San Fernando Road and Glendale Boulevard. Plaintiff was struck in the right leg by a rope that was being used by the employees of Defendant, a rope being used to extract underground cable, where extreme pressure was required. The rope snapped under pressure, struck Plaintiff on the right calf portion of his leg, and caused him to lose his balance and stumble into a 2-foot trench.
Settlement Discussions
Plaintiff contends he demanded $125,000 and Defendants offered nothing until the mandatory settlement conference, when the offer was $90,000.
