Facts

On October 23, 1992, Plaintiff Marcos Ocampo, a 23-year-old farm worker, was injured when he was struck by a tractor in the field, while working on Defendant Filice Farms picking crew. Ocampo was a temporary field worker sent to Filice Farms by Labor Contractor, Quintero, Inc. Ocampo received Workers' compensation benefits from the carrier for Quintero, Inc., and sued Filice Farms in Federal Court.
