Facts
On April 15, 1993, Plaintiff Joseph Sullivan, a 78-year-old security guard, was employed by AFI Security, Inc., and was assigned to the Defendant Fibre Fuel Products, Inc., facility in Azusa. Employees of Fibre Fuel, including Defendant Jose Jimenez, drove their personal vehicles to the "office" to clock out for the day. At approximately 10 p.m., Sullivan started a perimeter check and was walking through the parking lot when Jimenez backed his vehicle from the "office" and struck Sullivan. Jimenez was uninsured.

Plaintiff-in-Intervention contends that after the liability phase verdict, Plaintiff and intervenor demanded $800,000 and Defendant Fibre Fuel Products, Inc., offered $500,000.

No surgical procedures were performed due to Plaintiff's age.
