Facts
On March 16, 1992, Charles Stieneke, a 31-year-old engineer from North Carolina, was in Los Angeles on business. He was admitted via the emergency room to Robert F. Kennedy Medical Center regarding left renal colic. Defendant Dr. Kiumars Bakshandeh diagnosed urinary obstruction per IVP and retrograde pyelogram. On March 18, 1992, a cystoscopy was performed, utilizing basket retrieval. Mr. Stieneke was discharged to a hotel room on March 19. His wife arrived late that night and accompanied her husband to Defendant's office on March 20. Defendant recommended further rest over the weekend, before the flight scheduled back to North Carolina. On March 22, upon arrival in North Carolina, Mr. Stieneke suffered a seizure and entered a coma at the airport; he was then transported to Rex Hospital. Brain death was confirmed on March 24, 1992, due to a pulmonary embolism which had formed from a prior Achilles tendon rupture and casting, which occurred 2 weeks before the collapse on March 22.
