In April 1992, Plaintiff Jill Virginia Gardner, a 28-year-old welder, was hired by Defendant City of Los Angeles' Department of Water and Power. She and a male welder, hired at the same time, were laid off in July 1992 for lack of work. In JuIy 1992, Plaintiff filed a complaint with the Department of Fair Employment and Housing. In December 1992, Plaintiff filed a discrimination action against the City of Los Angeles. No charges or complaints had been made before that.
