Facts

On September 2, 1992, Plaintiff Cecilia Spalla delivered a son and developed a rectovaginal fistula. Defendant Douglas Betelson, M.D., OB/GYN, recommended that Plaintiff wait 12 weeks post delivery to undergo surgical repair. Plaintiff requested and received an earlier surgical repair that broke down, 4 days post-repair. After 2 more surgeries and a colostomy, Plaintiff is unable to have intercourse or control her bowels due to an alleged sphincter injury. At the time of the injury, Plaintiff was a 32-year-old packager.
