On June 30, 1993, Plaintiff Graciela Ochoa, a 29-year-old waitress and cashier, was a passenger on a bus when Defendant Halbert Sluder struck the bus in a sideswipe collision and then cut it off. Plaintiff alleged that when the bus braked abruptly to avoid the collision, she fell out of her seat and hit her head on the bus pole before falling on the floor. Sluder and Orange County Transportation Authority (OCTA) were named as Defendants.
