Defendant was employed by Defendant baseball team for young boys. The Defendant employee purchased a cart on behalf of the team for use on the playing field. The cart was stored at the employee's house. On May 12, 1991 the employee's son took the cart without permission and gave a ride to a 15-year-old male friend. The cart rolled over, causing the friend to fall and resulted in the friend's death. Plaintiffs were the decedent's mother, grandmother, and sister.

Defendants contend they offered $50,000 and Plaintiffs made a 998 demand in the amount of $350,000.
