Audrey Fredenburgh, a 52-year-old accounting supervisor with the Riverside County treasurer tax collector's office, went to Defendant Riverside Community Hospital on July 26, 1991, with a fever and complaints of severe back pain. She was seen by Defendant Dr. G. Michael Riewe whose exam revealed her neck to be supple; he concluded that, although the patient had a bacterial infection, it was a viral infection and did not warrant antibiotics. Riewe sent the patient home. Three days later and at the Riverside Medical Clinic, Defendant Dr. James Carpentier also saw Mrs. Fredenburgh who again complained of severe back pain which Carpentier believed was consistent with disc disease. On August 1, 1991, Audrey Fredenburgh died of undiagnosed bacterial meningitis. Clyde Fredenburgh, the decedent's husband, and their 3 children sued Riewe, Riverside Medical Clinic, Riverside Community Hospital, and Dr. James Carpentier. The hospital was dismissed from the lawsuit.
