Facts

On August 28, 1988, Plaintiff's mother, at 33 weeks gestation and following an automobile accident, was taken to Saint Mary Desert Valley Hospital emergency room. Her private OB/GYN, Defendant Dr. Young, age 72 years, was called. The patient was assessed by the ER doctor. Defendant arrived at the hospital later that day and admitted the patient to labor and delivery. Approximately 2.5 hours later, the patient was transferred to Loma Linda University Medical Center. No cesarean section was performed prior to the transfer; the Plaintiff was born with severe brain damage and spastic quadriplegia.
