Facts
On September 7, 1992, both parties were returning home from Las Vegas on Interstate-15 and were about 30 minutes south of Las Vegas when Defendant Robert Millican traveling in the number 2 lane passed Plaintiffs' vehicle traveling at 35 to 40 mph. Defendant then moved into the number one lane and struck the right front of Plaintiffs' vehicle with the left rear of his vehicle. Plaintiffs were driver Emil Feuerwerker, a 69-year-old scrap metal worker, and passengers Ibi and Moshe Feuerwerker. At the time of the accident, Ibi Feuerwerker was a 64-year-old homemaker, and Moshe Feuerwerker was a 43-year-old limousine driver.

Defendant contends that he made an initial 998 offer in the amount of $2,001 to each Plaintiff. Defendant further contends that following the arbitration, he made a second 998 offer in the amounts of $4,711 to Emil, $4,361 to Ibi, and $0 to Moshe.
