Facts

On April 22, 1988, off-duty LAPD Defendant officer went to pick up court papers from the manager of an apartment owned by his fiancee. Upon noticing suspicious activity, the officer retrieved and concealed his .45 automatic pistol. He got into an argument with tenant Frank Hansen, III, a 29-year-old construction laborer. The argument was over an extension cord which was strung between apartments, a violation of fire ordinances. Hansen picked up a 29-inch pool cue segment and Defendant officer removed a concealed .45 automatic pistol and killed Hansen, before he struck the officer. Plaintiff was the decedent's 11-year-old son, Frank Hansen, IV. Defendant city's counsel did not represent the Defendant officer in this trial.

Defendant City of Los Angeles contends it made no offers and Plaintiff demanded $1,043,000. Plaintiff contends he made no demands and received no offers from Defendant City of Los Angeles.

Plaintiff settled his medical malpractice cause of action, with the Defendant hospital and doctors who treated his father's gunshot wounds, for a minimal amount of money; Plaintiff also settled with officer for a $900.
