Facts

On June 17, 1995, the plaintiff wife, a 71-year-old homemaker, was accompanying the plaintiff husband, a 75-year-old retired construction worker, in a Medi-Van owned by the defendant to a location for a dialysis treatment. The plaintiff husband was seated in a wheelchair at the time of the accident. The driver of the Medi-Van, after stopping at a boulevard stop, was struck by an uninsured motorist traveling on the through highway. The plaintiffs brought the within action based on a negligence theory of recovery.

Settlement Discussions

The plaintiffs demanded $154,000. The defendants offered $70,000.

Injuries

The plaintiffs suffered bruised ribs and multiple soft tissue injuries requiring chiropractic treatment and physical therapy.

Other Information
