In January, 1992, the plaintiff, a 44-year-old resident apartment manager, lived at a controlled entry apartment complex owned by plaintiff's employer, defendant owner. On January 25, 1992, the plaintiff was raped in the underground garage of the apartment complex. The rapist was not found. The plaintiff brought the within action based on negligence and misrepresentation theories of recovery.
