Facts

In 1989, the plaintiffs purchased a commercial office building in Los Angeles County from the defendant for $1,200,000. The plaintiffs alleged that in 1994, they observed water leaks in an exterior wall and a partition wall within a suite of the building. The plaintiffs brought this action based on breach of warranty, breach of contract, negligence, misrepresentation and fraud theories of recovery.

Settlement Discussions

The plaintiffs demanded $72,500. The defendant offered $12,500.

Damages

$120,000 (for repair of alleged defects).

Other Information

The settlement was reached approximately one year after the case was filed. The settlement was confidential and was obtained through the mediation efforts of the Hon. Donna Melby. Mutual releases were exchanged.
