Facts

On December 30, 1994, the plaintiff, a 26-year-old tow truck driver, was traveling northbound on Interstate 710 when the defendant lost control of his truck, slamming into the wall and then into the plaintiff's vehicle. The plaintiff brought this action against the defendant based on a negligence theory of recovery.

Settlement Discussions

The plaintiff made a $65,000 settlement demand which was accepted by the defendant.

Damages

Property damage resulting in a total loss of the plaintiff's vehicle claimed.

Injuries

The plaintiff alleged that he suffered from a 6.0 cm. sagittal scalp laceration; back, neck, chest, right ankle/foot, left forearm/wrist pain; and a headache as a result of the accident.

Other Information

The settlement was reached approximately six months after the case was filed.
