On November 30, 1991, the decedent, a 53-year-old homemaker, underwent gall bladder surgery at Memorial North Hospital in Modesto. The defendant, Askia Sonyika, was the anesthesiologist for the surgery. The plaintiff alleged that subsequent to the surgery, the decedent showed signs of a stroke which eventually led to her death on December 5, 1991. The plaintiffs, decedent's husband and adult children, brought this action against the defendants based on medical negligence theories of recovery.
