Facts

On April 3, 1991, the plaintiff, an 11-year-old girl, was a passenger in a vehicle which went out of control when attempting to avoid another vehicle making a lane change. The vehicle went onto the median divider and struck a light standard pole causing injuries to the plaintiff. The plaintiff alleged that she suffered serious head injuries. She brought this action against the defendant city based on a negligence theory of recovery.

Settlement Discussions

The plaintiff made a $3,800,000 settlement demand. The defendant made no settlement offer.

Injuries

The plaintiff alleged that she suffered a severe head injury resulting in spastic quadriparesis and requiring assistance with the activities of her daily living as a result of the accident.

Other Information

The settlement was reached approximately three years and six months after the case was filed. Mediations were held on June 14, 1995, and August 8, 1995, before Daniel Quinn, Esq. of Stockton (a private mediator) which resulted in the settlement.
