Facts

On May 3, 1993, plaintiff John Quinn's estranged wife called the California City Police Department and stated that the plaintiff was despondent that he made statements which led her to believe he was suicidal, and that the conversation had ended with a loud bang. Four police officers responded to the house, and after receiving no response at the front door, forcibly entered the house. The plaintiff, who was in his bedroom with the door closed, fired his shotgun in the direction of the officers. The Kern County SWAT Team was called to the scene and eventually negotiated the plaintiff's surrender. After the defendant was removed from the house, Officers Linda Lunsford and Steven Patillo conducted a search of the house. The plaintiff was tried criminally and acquitted, asserting that he mistook the police officers for burglars. The plaintiff brought this action against California City, County of Kern, members of the Kern County SWAT Team, the California City Police Department Officers, his ex-wife and member of his ex-wife's family based on __________________ theories of recovery. Officer King, who was the officer nearest the plaintiff's bedroom when the plaintiff fired his shotgun, filed a counter-claim against the plaintiff for negligence. King alleged hearing loss as a result of the gunshot. On the day of trial, King settled with the plaintiff homeowner's insurance carrier and received $12,000.

The plaintiff made a settlement demand for $250,000. The defendant made a Rule 68 offer of compromise for $2,501.

The plaintiff claimed damages of $145 million dollars.
