On May 11, 1994, plaintiff Cynthia Baricza, a 35-year-old auto parts clerk/driver, was traveling eastbound on Ohio Street near Barrington in Los Angeles. The plaintiff was driving a 1992 Chevrolet pickup. As she was stopped for traffic, the plaintiff was rear ended by a vehicle operated by defendant Stuart Lansky. Defendant Lansky was driving a 1971 Volkswagen square-back. The plaintiff brought this action against the defendant based on negligence theories of recovey.

Settlement Discussions

The plaintiff made a settlement demand for $56,000, increased to $150,000 at trial. The defendant made a C.C.P. º998 offer of compromise for $3,500.
