Facts

Plaintiff Daniel Blair, a 38-year-old, and plaintiff Robert Camacho, a 35-year-old, were employed as hazardous waste materials specialists by the defendant county of Riverside. The plaintiffs contended they were wrongfully terminated by the defendants (their supervisors) as a result of complaints by the plaintiffs to Cal OSHA, Fed OSHA and their own department. Plaintiff Blair, a permanent employee, claimed constructive termination as a result of harassment. Plaintiff Camacho, a probationary employee, was fired. The plaintiffs brought this action against the defendants based wrongful termination, unlawful harassment and whistleblower theories of recovery.

Settlement Discussions

The plaintiffs made a C.C.P. º998 settlement demand for $100,000 for each plaintiff at the outset of the case and made a later offer of $375,000 for each plaintiff. The defendants made no settlement offers.

Damages

Plaintiff Blair claimed to be unemployed or that he had only part-time jobs for about a year after his termination. Plaintiff Camacho contended he was unable to find any comparable work and that he had started a certification program in college to pursue teaching as a new career.
