Facts

On Jan. 19, 1996, the plaintiff, a 46-year-old administrator, was driving her automobile in the No. three lane, southbound on U.S.101 north of Hampshire Road in Thousand Oaks. The defendant was driving a 1985 Toyota 4x4 pick-up truck southbound in the No. one lane. The defendant's vehicle drifted left onto the emergency shoulder of the freeway and swerved back across the Nos. one, two and three lanes colliding with the left rear of the plaintiff's vehicle. The force of the impact caused the plaintiff's vehicle to skid and veer to the left, striking the center dividing wall separating the northbound and southland lanes of traffic. The plaintiff brought this action against the defendant based on negligence theories of recovery.

Settlement Discussions

The plaintiff made a C.C.P. º998 settlement demand for $100,000. The defendant paid policy limits after completion of discovery.
