Facts
On Oct. 18, 1991, plaintiff Miguel Carmona, a 33-year-old vice president of production, was driving a Volkswagen in which plaintiff Salvatore Aveta, a 61-year-old retiree, was a passenger. The plaintiffs were traveling in defendant Familian Pipe & Supply's parking lot near the loading dock to the warehouse. The plaintiffs claimed that the defendant pulled its tractor forward and struck the plaintiffs' car. The defendant contended that its employee was backing up the tractor to the loading dock when the plaintiffs attempted to pass between the truck and the block wall. The plaintiffs brought this action against the defendant based on negligence theories of recovery.
