Facts

On June 28, 1994, plaintiff Andrew Hernandez, a 26-year-old mover, went to visit his friend at defendant Woods Apartment complex. Upon leaving the apartment, the plaintiff slipped and fell on the second step of an exterior stairway. The plaintiff fell down the entire 15-stair stairway. A witness indicated that the stairs were wet and soapy. The plaintiff brought this action against the apartment complex and the property manager based on negligence, premises liability and respondeat superior theories of recovery.

Settlement Discussions

The plaintiff made a C.C.P. º998 settlement demand for $125,000. The defendants made a C.C.P. º998 offer of compromise for $20,000.
