On May 27, 1994, plaintiff Gale, a 45-year-old legal secretary, was driving her Ford Bronco when it was rearended by a vehicle operated by defendant Eric Tozier, a 17-year-old student. The plaintiff's vehicle then rearended the vehicle in front of her vehicle. The plaintiff brought this action against the defendants,Tozier and his employer, based on negligence and respondeat superior theories of recovery.
