Facts
On Aug. 6, 1993, the decedent, a 62-year-old bookkeeper, presented at defendant Mercy American River Hospital for a colon resection and suffered hypotension in recovery. She was treated with fluids, which the plaintiffs claimed were not properly monitored, and the excess fluid lodged in her lungs causing pulmonary edema. A pulmonary specialist was called in to treat the decedent, and she began to improve. On Aug. 5, 1993, the decedent began to show signs of respiratory distress which was not reported to the physician. The nurses diagnosed the decedent's problem as anxiety and the decedent died at 3 a.m. on Aug. 6, 1993. The autopsy noted the cause of death as adult respiratory distress syndrome. The plaintiffs, the decedent's husband and two adult sons, brought this wrongful death action against the defendant hospital based on medical malpractice and negligence theories of recovery.
