Facts

On Aug. 3, 1993, the plaintiff, a 27-year-old change manager analyst, was standing near a catering truck on his employer's premises when he was struck from behind by a co-worker running an errand for his supervisor in an employer-owned vehicle. The plaintiff was crushed between the vehicle and the catering truck owned by the defendant which was parked behind the vehicle. The plaintiff brought this action against the defendant based on negligence theories of recovery.
