Facts

On April 17, 1994, the plaintiff, a 75-year-old retiree, walked into the corner of aluminum bleachers at the baseball field at La Cienega park in Beverly Hills. The bleachers had been installed approximately four years prior the accident by a subcontractor of the defendant company. The defendant company was the general contractor involved in renovating the park. The plaintiff brought this action against the defendant company based on product liability theories of recovery.

Settlement Discussions

The plaintiff made a C.C.P. º998 settlement demand for $50,000. The defendant made a settlement offer of $10,000.
