Facts

The plaintiff and defendant both operated automobile transportation brokerage businesses. In August 1995, the defendant bought the plaintiff's client list, phone numbers and trade name and the plaintiff promised not to compete in the industry. The sales contract called for 10 monthly payments of $3,500 each. The defendant made only one payment in September 1995. The plaintiff seller brought this action against the defendant buyer based on breach of contract and fraud theories of recovery.

Settlement Discussions

The plaintiff made a settlement demand for $31,500 with a waiver of fees and costs. The defendant made no setttlement offers.
