On Oct. 28, 1993, the decedent, a 62-year-old employee of the city of Los Angeles, was driving a lawnmower during the course and scope of his employment with the City of Los Angeles Department of Parks & Recreation. The decedent was struck by the fully extended outrigger of a crane in the adjacent lane, causing multiple crush and fracture injuries. The decedent died during surgery on Nov. 9, 1993. The plaintiff, the decedent's widow, brought this action against the defendants, the crane operator and the owner, based on negligence theories of recovery.
Settlement Discussions
The plaintiff made a C.C.P. º998 settlement demand for $1 million. The defendants made a C.C.P. º998 offer of compromise for $880,000.
Damages
The plaintiff claimed loss of wages and loss of home services. She alleged that if the decedent had worked until age 75, he would have earned $384,163. The plaintiff also claimed funeral and burial expenses in the amount of $5,516.71.
