On June 14, 1986, the plaintiff, a 4+-year-old girl, fell from a second story common area balcony while visiting her friend. The plaintiff fell onto a cement area at ground level. The plaintiff brought this action against the defendant based on premises liability and negligence theories of recovery.

The plaintiff made a C.C.P. º998 settlement demand for $662,000. The defendant made a C.C.P. º998 offer of compromise for $100,000.
