Plaintiff Romaric Otis, a 62-year-old special machine builder and senior mold maker, worked at defendant ITT Cannon. The defendant claimed it was forced to lay off the plaintiff and other employees due to adverse economic conditions facing its military aerospace division. The plaintiff exercised his seniority rights to displace a less senior employee in a different job previously held by the plaintiff. The defendant claimed that the plaintiff failed to perform the job duties of the displaced employee, as required by the employee handbook and on July 1, 1992, the plaintiff was terminated for cause. The plaintiff brought this action against the defendant based on breach of contract and discrimination theories of recovery.
