Facts
On Oct. 21, 1995, the plaintiff, a 7-year-old girl, suffered burns to her chest, abdomen and thighs when soup purchased from the defendant's restaurant was placed onto the plaitiff's lap along with other take-out foods in a carry-out box, and spilt on the plaintiff. The plaintiff brought this action against the defendant restaurant based on negligence theories of recovery.
Settlement Discussions
The plaintiff made a C.C.P. º998 settlement demand for $300,000. The defendant made a C.C.P. º998 offer of compromise for $45,000.
Damages
The plaintiff claimed special damages in the amount of $4,733.40.
Injuries
The plaintiff alleged she suffered first and second degree burn on her chest, abdomen and thighs. The plaintiff had de minimis residual hyperpigmentation. Additionally, the plaintiff had minor residual scarring on her hips.
Other Information
The settlement was reached approximately six months after the case was filed.SETTLEMENT CONFERENCE: A settlement conference was held on Dec. 20, 1996 before Judge Stoll resulting in the reported settlement. Both parties agreed that the plaintiff, whose initial burns appeared severe, had made an excellent recovery and displayed only minor residual scarring.
