On May 4, 1993, plaintiff Sherry Manriquez, a 28-year-old teller, was driving her vehicle on Highway 9. Defendant Patrick McDonald backed his truck out from a shopping center parking lot onto Highway 9 and collided with the passenger side of the plaintiff's vehicle. The plaintiff was the defendant's former tenant. The plaintiff brought this action against the defendant based on negligence theories of recovery.
